Traffic crime and its prevention

Obvious from the headline, the theme of this theses is traffic crime and its prevention. Although traffic crime is by society quite overlooked kind of criminality, it is more probable that any person will become one of the traffic criminals or a victim of someone elses' criminal behaviour within traffic, rather than he or she will find him or herself being a victim or a perpetrator of a crime from another crime field. Losses of lives, health or property losses which are unfortunately huge part of it are also not insignificant. Being aware of the fact that the most severe consequences of traffic crime happen at the time of transport accidents, considerable part of the thesis is dedicated to the problematics of such accidents. Although traffic crime is not unusual within various kinds of transport it is much less frequent than in the case of road transport which is the kind of transport the theses talks about. The aim of this work is to highlight not only the meaning of transport crime and accidents connected to it but also the possibilities of its prevention. Summary: Traffic belongs to humanity since time immemorial. First people relied on their own feet, later on animal power. The biggest change came with the invention of the wheel 3,500 years BC. In the 19th century, first car was invented. Ever since the vehicles are constantly being improved. Simultaneously with traffic the traffic crime originated too. The topic of my thesis is Traffic crime and its prevention. I have chosen this topic because I think that it is a current issue and because transport is a normal part of our every- day lifes. The purpose of my thesis is to analyse main causes of traffic crime and clarify basic preventive activities on the national and international level. This thesis is composed of five chapters, each of them dealing with different issues relating to transport crime a its prevention. Chapter one is about fenomenology and explanation of the concept of transport crime, its specialities and on the most frequent transport crime. The impact of media on judicial determination in cases of traffic crimes

Media influence over court rulings in traffic crime cases The aim of this thesis is to analyze the way media report about traffic crimes and provide a comparison between cases that attracted media attention and cases that didn't. The author investigates the possibility that courts are influenced in thein decision making by the general public, the opinion of which is shaped mostly by mass media outlets which unfortunately often release speculations as proven facts. To demonstrate the possibility of media influence to the reader, the author compares similar cases and shows how different the court ruling was when the case wasn't a subject of attention of mass media. Part of this analysis consists of a letter to the judge who presided over one of such cases, the incident on D1 motorway in 2010. The conclusion is that there's potential for such influence, but it's impossible to be absolutely certain that it already exists. The threat of such influence will, however, grow over time as new technologies are introduced, that make it very easy to spread information and consume it. In a newly forming information society, the ability to influence anything ranging from minor court battles to elections is considerably increased and poses a potential threat to the impartiality of courts, which is vital to a modern...

This Master's Thesis examines the issue of criminal law in the Czech road traffic sector and crime prevention. The Thesis tackles the basic concepts of traffic law and traffic accidents, which are the most visible results of traffic offenses, that cause damage to life, health and property. The problem of traffic accidents is their unpredictability, as no driver wants to cause them voluntarily. However, these are often the result of the driver's own behaviour. The Thesis offers a new approach to the issue of traffic accidents where the most common cause of accidents is the violation of traffic regulation. In my assessment, the driver's distraction, recklessness towards other drivers and a poor driving technique figures among the key factors. This statement is proved by an analysis of existing accident statistics and their comparison with the drivers' actual behaviour. The highest number of criminal offenses, such as manslaughter, personal injury or property damage is linked to the consequences of traffic accidents. These offenses are committed in most cases by gross negligence. The second group of criminal offenses consists of intentional crimes, which encompasses especially endangerment while intoxicated and justice obstruction, caused in most of the cases by driving a motor vehicle without being in hold of...

EKONOMIE KRIMINALITY NA PŘÍKLADU DOPRAVNÍCH NEHOD V ČR

Tato práce se zabývá racionálním chováním ekonomických subjektů v podmínkách rizika v mimotržní oblasti ekonomiky, dopravní kriminality. Na základě analýzy dopravní nehodovosti, počtu usmrcených a výši hmotné škody se potvrzuje, že změna pravděpodobnosti dopadení představovaná dopravně bezpečnostními akcemi ovlivňuje dopravní kriminalitu v ČR. Práce dále zkoumá, zda také změna výše trestu představovaná zavedením novely zákona č. 411/2005 Sb., o silničním provozu, ovlivňuje dopravní kriminalitu v ČR. Na základě analýzy těžce a lehce zraněných osob a osob usmrcených dochází k závěru, že změna trestu na chování řidičů na českých silnicích vliv nemá.
